Will court dismiss lawsuit against AZ's "Whole Woman's Healthcare" act?

Thursday, Oct 4, 2012
WHO:  Senior Counsel Steven H. Aden

WHAT:  Available for media interviews following hearing in Planned Parenthood of Arizona v. Betlach

WHEN:  Immediately following hearing, which begins at 1:30 p.m. Arizona Time (PDT), Friday, Oct. 5

WHERE:  U.S. District Court for the District of Arizona, Sandra Day O’Connor U.S. Courthouse, 401 W. Washington St., Phoenix

ADDITIONAL INFORMATION:

The hearing concerns a lawsuit filed by Planned Parenthood against H.B. 2800, the “Whole Woman’s Healthcare Funding Prioritization Act,” which closes loopholes that allowed taxpayer dollars to fund abortions and prioritizes family planning funds to health care entities that best provide comprehensive health care to women. The hearing will consider Planned Parenthood’s motion for a preliminary injunction against the law, as well as the state’s motion to dismiss the lawsuit.

Aden, whom Arizona Attorney General Tom Horne appointed as a special assistant attorney general to assist the state in defending the law, will argue against the preliminary injunction motion. Aden is working with Solicitor General Dave Cole and Assistant Attorney General Tom Collins. Alliance Defending Freedom Litigation Counsel Catherine Glenn Foster will argue in support of the state’s motion to dismiss.
