SAN FRANCISCO — Attorneys defending California’s marriage amendment, including Alliance Defense Fund Senior Legal Counsel Austin R. Nimocks, will hold a press conference following a hearing Thursday at the U.S. Court of Appeals for the 9th Circuit in Perry v. Brown.

The arguments concern a motion, filed by the official proponents of Proposition 8, that seeks on appeal to have the district court decision that struck down the amendment thrown out on the grounds that then-District Judge Vaughn Walker should have recused himself. The other motion, filed by those seeking to tear down the amendment, seeks an order to unseal video recordings of the district court trial.

“The American people deserve a court system that upholds the integrity of the judicial process,” said Nimocks. “The orders we are requesting are necessary for that reason. Violating standards, rules, and court orders threatens to undermine the public’s confidence in the federal court system.”

Lead counsel Charles J. Cooper of the Cooper & Kirk law firm will argue Thursday before the 9th Circuit. ProtectMarriage.com is the banner organization for the official proponents and campaign committee of California’s Proposition 8.
