Description: When the Biden administration removed the safeguard of in-person dispensing for the abortion drug mifepristone, it intentionally opened the door for out-of-state pro-abortion activists and doctors to mail streams of high-risk abortion drugs into pro-life states. Louisiana, which has chosen to protect the lives of unborn babies, and Rosalie Markezich, a Louisiana woman coerced into taking abortion drugs that her boyfriend obtained via mail from a doctor in California, are suing the U.S. Food and Drug Administration for unlawfully approving this reckless mail-order abortion-drug scheme.

U.S. Food and Drug Administration to allow high-risk abortion drugs to continue flowing into pro-life states while the state of Louisiana and ADF attorneys litigate the case at the U.S. Court of Appeals for the 5th Circuit:

“We are disappointed by this decision that allows the FDA and the abortion industry to continue nullifying Dobbs and its promise to return the issue of abortion to the people. It’s high time the Biden FDA be held accountable for the destruction it has caused with this high-risk drug. Together with Louisiana Attorney General Liz Murrill’s office, we look forward to litigating our appeal at the 5th Circuit to protect mothers and their children.”

ABOUT Erik Baptist

Erik Baptist serves as senior counsel and director of the Center for Life at Alliance Defending Freedom where he leads the team’s litigation and advocacy efforts to protect unborn babies and their mothers from the harms of abortion. ABOUT Erin Morrow Hawley

Erin Morrow Hawley serves as of counsel at Alliance Defending Freedom, supporting the Center for Life Team. She also works at the law firm Lex Politica, which focuses primarily on election law, voting rights, campaign finance, political activities compliance, corporate regulatory law, and related areas. Before joining ADF, Hawley practiced appellate law at Kirkland and Ellis LLP, Bancroft LLP, and King & Spalding LLP. Hawley has litigated extensively before the U.S. Supreme Court as well as numerous federal courts of appeals and state courts of last resort. She also worked at the U.S. Department of Justice, serving as counsel to Attorney General Michael Mukasey. As an academic, Hawley served as an associate professor of law at the University of Missouri and she also taught constitutional law as a senior fellow at the Kinder Institute for Constitutional Democracy. Hawley is a former law clerk to U.S. Supreme Court Chief Justice John G. Roberts and Judge J. Harvie Wilkinson of the U.S. Court of Appeals for the 4th Circuit. Hawley received her bachelor’s degree in Animal Science from Texas A&M University and her law degree from Yale Law School where she served as a Coker Fellow in Constitutional Law and on the Yale Law Journal. She is an active member of the Missouri and District of Columbia bars and is admitted to practice before the U.S. Supreme Court and various federal courts of appeals.
